Buddzy Terms of Use

1. Introduction and Acceptance of Terms

Welcome to Buddzy. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Buddzy ("we", "our", or "us"), concerning your access to and use of the Buddzy mobile application and related services (the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. By continuing, you confirm that you meet the minimum age requirements set out in Section 3. If you do not agree, do not access or use the Service.

2. Service Description

Buddzy is a global mobile platform that allows users to assign subjective rankings to personal contacts ("friends") through gamified interactions. Rankings are calculated via point allocations based on user interactions.

Users may share these rankings internally or externally via automated content such as videos, images, and leaderboards. Rankings are personal and have no bearing on any objective metric or evaluation.

3. Eligibility

• Age: You must be at least 13 years of age, or older if required by the laws of your country of residence (e.g., 16+ in some jurisdictions);
• Possess the legal capacity to enter into a binding agreement;
• Not be barred from using such services under applicable laws.

Buddzy is not intended for children under 13. By using the Service, you declare that you meet the applicable minimum age. We may suspend or terminate access if we learn that an account holder does not meet these requirements.

4. Registration and Account Management

• Provide accurate, up-to-date information;
• Keep your contact details current;
• Secure your account credentials.

Changing your phone number without updating your account may lead to permanent data loss. You are solely responsible for maintaining control over your account. You must not misrepresent your age or identity.

5. License Grant

Buddzy grants you a non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use. All other rights are reserved.

• Do not copy, modify, or distribute the app or its content without consent;
• Do not attempt to extract source code or reverse engineer features;
• Do not exploit any part of the Service commercially.

6. User Content

You retain ownership of the content you create (names, rankings, images, etc.), but grant Buddzy a royalty-free, worldwide license to:

• Use, reproduce, adapt, and display such content to provide and improve the Service;
• Generate and share derivative works (e.g., auto-generated videos);
• Use such content in marketing or promotional material (with anonymization if applicable).

You are responsible for the legality, accuracy, and decency of your content.

7. Sharing and Generated Media

Buddzy may automatically create videos, images, and summaries based on your activity. By using the app, you:

• Consent to such content being generated, displayed, and shared;
• Understand that these outputs may be shown to your friends or publicly, depending on your privacy settings;
• Grant Buddzy a license to use them in its services and promotional efforts.

Buddzy is not responsible for the content of automatically generated media, which depends on your inputs. You agree to review before sharing. You may not reuse generated media for commercial use without our prior consent.

8. Profile Settings and Privacy Controls

Users can control their visibility preferences, including:

• Displaying or hiding their rankings and friend lists;
• Choosing whether their interactions (e.g., giving points) appear to others.

Settings are accessible in-app. By default, some content may be visible to others. Buddzy encourages users to customize their preferences.

9. Code of Conduct and Fair Use

• Interact respectfully and responsibly;
• Avoid spamming, bullying, or impersonating others;
• Do not use automated tools (bots, scripts) to manipulate rankings or earn points fraudulently;
• Do not manipulate the app's mechanics (e.g., fake accounts to boost rankings);
• Do not use features to harass or discriminate.

Buddzy reserves the right to monitor activity to detect abuses, without prior notification. Users who violate these rules may face warnings, suspensions, or permanent bans.

10. Internal Penalty Mechanism

Buddzy offers a private "demotion" or penalty feature. This allows users to internally downgrade someone in their own rankings without visible or public consequence. This feature is strictly personal and never publicly shared, displayed, or revealed.

11. Reporting and Moderation

• Investigate complaints confidentially;
• Issue sanctions where necessary;
• Allow blocked or flagged users to appeal decisions through support.

Moderation is human-driven and guided by community safety principles.

12. Notifications and Communications

By using Buddzy, you agree to receive:

• System alerts (e.g., ranking changes);
• Promotions, announcements, and friend activity notifications.

Notification preferences can be managed in the app. You may opt out of non-essential communications.

13. In-App Purchases and Virtual Goods

Buddzy may offer in-app purchases, including:

• Virtual points;
• Customization packs;
• Boosters or temporary ranking enhancements.

Purchases are final. Buddzy is not responsible for accidental purchases. Refund policies comply with applicable app store rules.

14. Optional Tools and Third-Party Integrations

Buddzy may provide you with access to third-party tools or content. We do not monitor or control these tools and disclaim any liability arising from your use of them. You use such optional tools entirely at your own risk and discretion.

14.1 Third-Party Processing and AI

Buddzy uses third-party services (e.g., AI for avatar generation, cloud storage) that process your data under our control. We are not responsible for malfunctions of these third parties. See our Privacy Policy for the list of subprocessors.

15. Errors, Inaccuracies, and Omissions

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.

16. Termination and Account Deletion

• Breach of these Terms;
• Fraudulent activity;
• Extended inactivity (12+ months).

For inactivity, suspension after 6 months, termination after 12 months. Upon deletion: All user data will be permanently deleted within 30 days; Public content may persist unless otherwise requested. To delete your account, visit buddzy.app/delete-account or use the in-app settings.

17. Data Protection & GDPR Compliance

• Data access and correction;
• Account deletion and erasure;
• Data portability;
• Objection to profiling or marketing.

We store data securely. Data transfers outside the EU follow legal frameworks.

18. Retention Policy

• Deleted accounts: data removed within 30 days;
• Inactive accounts: suspended after 6 months, terminated after 12 months;
• Banned users: data retained up to 12 months;
• Payment receipts: up to 10 years (legal obligation);
• Audit trail (deletion requests): 36 months.

Anonymized data (e.g., aggregated stats) may be retained indefinitely to improve the service.

19. Intellectual Property

All Buddzy branding, source code, UI/UX, algorithms, and media are our exclusive property. Reuse or reproduction is prohibited without written approval.

20. Disclaimer of Warranty

• No guarantee of continuous service;
• No guarantee of accuracy or compatibility;
• Service is provided "as is".
• No warranty on social or emotional impacts of features (e.g., rankings or notifications).

21. Limitation of Liability

• No liability for indirect damages or loss;
• Maximum liability is €100 or last 6 months' payments.

Buddzy is not liable for damages arising from third-party features (e.g., AI-generated avatars), user interactions (e.g., subjective rankings or shares), or any data loss due to external factors. This limitation applies even in cases of negligence, except for proven intentional fault.

22. Indemnity

You agree to indemnify Buddzy for damages from your use, misuse, or legal violations. This includes any claims related to defamatory, illegal, or harmful content generated or shared by you (e.g., rankings, automated media), or violations of third-party rights (e.g., unauthorized use of contacts or images).

23. Force Majeure

We are not liable for delays due to causes beyond our control, such as disasters, war, or outages.

24. Changes to Terms

We may update these Terms. Continued use of the Service after changes constitutes acceptance. Updates will be notified via the app or email. Lack of objection within 30 days constitutes acceptance.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of France. Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Paris, France, unless mandatory consumer protection rules of your country of residence provide otherwise. If you are a consumer residing in the European Union, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

26. Severability

If any part is invalid, the rest remains valid.

27. Entire Agreement

These Terms and Privacy Policy override any previous agreements.
